Suspension - 180 Days;
2. Effective July 5, 2002. The hearing panel found, by default, that respondent was retained to prepare a trust and failed to review the contents of the trust with his clients or to undertake reasonable efforts to explain the trust to the extent reasonably necessary to permit them to make informed decisions regarding the representation. Respondent also failed to answer a request for investigation served by the Grievance Administrator. Respondent's conduct was in violation of MCR 9.104(A)(1)-(4) and (7); MCR 9.113(A); MCR 9.113(B)(2); and Michigan Rules of Professional Conduct 1.2(a); 1.4; 8.1(b); and 8.4(a) and (c).
The hearing panel ordered that respondent's license to practice law be suspended for 180 days and that he pay restitution in the amount of $300.00. Costs were assessed in the amount of $403.69.
