NOTICE OF REPRIMAND AND RESTITUTION (By Consent)

Case No. 01-75-GA Notice Issued: March 1, 2002 James W. Robinson, P-26171, Newberry, Michigan, by the Attorney Discipline Board Upper Peninsula Hearing Panel #1.

1. Reprimand; 2. Effective March 1, 2002. The respondent and the Grievance Administrator filed a stipulation for a consent order of discipline, in accordance with MCR 9.115(F)(5), containing the respondent's plea of no contest to charges in Count Four that respondent, in a probate matter, failed to timely prepare and file a closing statement, or a petition for continuing pendency on his client's behalf, which resulted in the suspension of his client's fiduciary powers; and failed to file a petition to evict his client's sister, as instructed by his client. Respondent was charged with violations of MCR 9.104(1)-(4); and Michigan Rules of Professional Conduct 1.1(c); 1.2(a); 1.3; 1.4; 1.16(d); 3.2; 8.4(a) and (c). The parties agreed that Counts One, Two and Three be dismissed and that respondent should be reprimanded. Costs were assessed in the amount of $8.74.
