NOTICE OF SUSPENSION AND RESTITUTION (By Consent)

Effective February 13, 2002.

The respondent and the Grievance Administrator filed a stipulation for a consent order of discipline in accordance with MCR 9.115(f)(5) which was approved by the Attorney Grievance Commission and accepted by the hearing panel. Respondent pled no contest to allegations that he failed to return unearned fees; failed to maintain the funds paid to him in a separate client trust account; commingled the funds with his own funds; failed to file a motion or brief on appeal on his client's behalf; and failed to communicate with his client regarding the status of the matter despite his client's repeated requests for information. Respondent was charged with violations of MCR 9.104(A)(1)-(4); and Michigan Rules of Professional Conduct 1.1(c); 1.2(a); 1.3; 1.4(a); 1.15(b); 1.16(d); and 8.4(a) and (c). The parties stipulated to the entry of an order suspending respondent=s license to practice law for 180 days and ordering him to pay restitution of $5,500.00. Costs were assessed in the amount of $189.17.
