NOTICE OF SUSPENSION Case No. 02-8-GA Notice Issued: June 24, 2002 Daniel F. Biernat, P-44947, Southfield, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #75.

Suspension - 180 Days;

2. Effective February 16, 2002. The hearing panel found by default that respondent, in a personal injury matter, failed to file a complaint on his client's behalf; failed to maintain reasonable communications with his client; abandoned his client's representation without taking reasonable steps to protect his client's legal interest; and failed to file an answer to a request for investigation served by the Grievance Administrator. Respondent's conduct was in violation of MCR 9.104(A)(1)-(4) and (7); MCR 9.113(A); MCR 9.113(B)(2); and Michigan Rules of Professional Conduct 1.1(c); 1.2(a); 1.3; 1.4(a) and (b); 1.16(d); 3.2; 8.1(b); and 8.4(a) and (c).

The hearing panel ordered that respondent's license to practice law be suspended for 180 days, to run concurrently with the suspension now in effect in Grievance Administrator v Daniel F. Biernat, Case No. 01-81-GA. Costs were assessed in the amount of $245.24.
