NOTICE OF SUSPENSION (By Consent)

1. Suspension - 45 days; 2. Effective January 31, 2002. The respondent and the Grievance Administrator filed a stipulation for a consent order of discipline, in accordance with MCR 9.115(F)(5), containing the respondent's plea of no contest to the allegations that respondent misappropriated an unearned $2,500.00 retainer fee by failing to deposit it into a client trust account; did not promptly refund the unearned fee; and neglected the client's legal matter. Respondent was charged with violations of MCR 9.104(A)(1)-(4); and Michigan Rules of Professional Conduct 1.1(c); 1.3; 1.15; 1.16(d); and 8.4(a) and (c). The parties agreed that respondent should be suspended for 45 days and pay costs in the amount of $29.56.
