The hearing panel found, by default, that respondent had committed the professional misconduct alleged in Formal Complaint 01-81-GA, specifically: In a personal injury matter, respondent neglected his client's matters; failed to keep reasonable communication with his client; abandoned his representation; falsely represented to his client that his matters were proceeding and that his cases were pending (even though one case had been dismissed and the second had never been filed); and failed to answer two requests for investigation served by the Grievance Administrator. Respondent=s conduct was in violation of MCR 9.104(1)-(4) and (7); MCR 9.113(A); MCR 9.113(B)(2); and Michigan Rules of Professional Conduct 1.1(c); 1.2(a); 1.3; 1.4; 1.16(d); 3.2; 8.1(b); 8.4(a)-(c).
The hearing panel ordered that respondent=s license be suspended for 180 days, to run consecutively to the one year suspension imposed in Grievance Administrator v Daniel F. Biernat, Case No. 00-169-GA (2001). Costs were assessed in the amount of $236.02.
