NOTICE OF SUSPENSION AND RESTITUTION (With Conditions)

Case No. 01-109-GA; 01-132-FA Notice Issued: December 19, 2001 Jonathan S. Baker, P-45707, Fenton, Michigan, by the Attorney Discipline Board Genesee County Hearing Panel #3.

Effective December 19, 2001.

The hearing panel found that respondent had committed the following misconduct: With regard to an OUIL matter, respondent neglected the matter; failed to timely respond to his client's inquiries regarding the status of the matter; and failed to timely inform his client of a conflict in scheduling with regard to his client's pre-trial court date. In five matters, respondent failed to return unearned fees and failed to answer requests for investigation served upon him by the Grievance Administrator. In four matters, respondent abandoned the representation of his clients. Further, respondent failed to file an answer to Formal Complaint 01-109-GA. Respondent's conduct was found to be in violation of MCR 9.104(1)-(4) and (7); MCR 9.113(A); MCR 9.113(B)(2); and Michigan Rules of Professional Conduct 1.1(c); 1.2(a); 1.3; 1.4(a) and (b); 1.16(d); 8.1(b); and 8.4(a) and (c).

The hearing panel ordered that respondent=s license be suspended for six months and that he pay restitution in the aggregate amount of $4,480.00. The hearing panel also imposed conditions relevant to the established misconduct and assessed costs in the amount of $642.41.
