NOTICE OF SUSPENSION (By Consent)

Case Nos. 01-78-GA; 01-95-FA Notice Issued: March 21, 2002 Thomas R. Hungerford, P-40000, Indian River, Michigan, by the Attorney Discipline Board Emmett County Hearing Panel.

Suspension - 180 Days;

Effective March 21, 2002.

The respondent and the Grievance Administrator filed a stipulation for a consent order of discipline in accordance with MCR 9.115(F)(5) which was approved by the Attorney Grievance Commission and accepted by the hearing panel. Respondent pled no contest to allegations that he failed to promptly notify his client that he had received funds on her behalf; failed to maintain the funds in a trust account; failed to promptly pay his client the funds to which she was entitled; misappropriated the funds; and failed to file an answer to a formal complaint served upon him by the Grievance Administrator. Respondent was charged with violations of MCR 9.104(1)-(4) and (7); and Michigan Rules of Professional Conduct 1.15(b); 8.1(b); and 8.4(a)-(c). The parties stipulated to the entry of an order suspending respondent=s license to practice law for 180 days. Costs were assessed in the amount of $30.54.
