1. Order Imposing ANo Discipline;@ 2. Effective September 12, 2001. On March 15, 2000, the hearing panel entered an order of dismissal which was appealed by the Grievance Administrator. Upon review, the Attorney Discipline Board found that respondent had committed misconduct, specifically: That respondent caused an affidavit to be notarized without the notary witnessing the signature, in violation of MCR 9.104(1)-(4); and Michigan Rules of Professional Conduct 8.4(a)-(c). The Board reversed the panel's dismissal and remanded the matter to the panel for a determination of discipline. Based on the absence of any aggravating factors and considerable evidence of mitigating factors, the panel issued an order of discipline imposing "no discipline." The Grievance Administrator filed a motion for reconsideration which the panel denied on November 7, 2001. Costs were assessed in the amount of $1,166.63.
