NOTICE OF REVOCATION AND RESTITUTION Case No. 04-101-GA Notice Issued: November 29, 2004

1. Revocation; 2. Effective August 27, 2001. 1 The respondent was found to be in default for his failure to file an answer to the formal complaint or appear at the hearing. Based on that default, the panel found that respondent, in a probate matter, misappropriated $50,000.00 from a beneficiary. Respondent was also found to have failed to answer a request for investigation served by the Grievance Administrator.

The panel found that respondent's conduct was in violation of MCR 9.014(A)(1)-(4) and (7); MCR 9.113(A) and (B)(2); and Michigan Rules of Professional Conduct 1.15(a)-(c); 8.1(a)(2); and 8.4(a)-(c). The panel issued an order revoking respondent's license to practice in Michigan, to run concurrently with the revocations ordered in Grievance Administrator v Patrick K. Collison, Case Nos. 01-90-GA; 01-151-GA and Grievance Administrator v Patrick K. Collison, Case Nos. 02-26-GA; 02-35-FA. The panel also ordered that respondent pay restitution in the amount of $30,577.12, plus interest. Costs were assessed in the amount of $1,773.85.
