NOTICE OF SUSPENSION AND RESTITUTION Case No. 00-195-GA Notice Issued: October 16, 2001 Steven A. Kargenian, P-41259, Shelby Township, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #107.

1. Suspension - 3 Years; 2. Effective July 19, 2001 The hearing panel found that respondent had committed professional misconduct as alleged in Counts 3, 5, 6 and 7 of Formal Complaint 00-195-GA, specifically: That respondent misrepresented to his clients that Articles of Incorporation had been filed on their behalf; fabricated or caused to be fabricated the Articles of Incorporation; presented these Articles of Incorporation to his clients when he knew or should have known that they were false; failed to return unearned fees; and failed to file answers to two requests for investigation served by the Grievance Administrator. Respondent's conduct was in violation of MCR 9.104(1)-(5) and (7); MCR 9.113(A); MCR 9.113(B)(2); and Michigan Rules of Professional Conduct 1.4(a); 1.15(b); 1.16(d); 8.1(b); and 8.4(a)-(c).

The hearing panel ordered that respondent=s license be suspended for three years, to run concurrently with a three year suspension ordered in Grievance Administrator v Steven A. Kargenian, Case Nos. 01-39-GA; 01-58-FA, effective July 19, 2001. Restitution was ordered in the amount of $1,463.00 and total costs were assessed in the amount of $1,298.25.
