1. Reprimand; 2. Effective August 3, 2001. On July 12, 2001, the hearing panel found that respondent had committed misconduct, specifically: Respondent failed to place a retainer in a trust account until earned; failed to timely file legal proceedings on behalf of his client; failed to keep a client informed as to the status of her matter; failed to respond to his clients' inquiries; failed to respond to two requests for investigation and a formal complaint served by the Grievance Administrator. Respondent's conduct was in violation of MCR 9.104(1)-(4) and (7); MCR 9.113(A); MCR 9.113(B)(2); and Michigan Rules of Professional Conduct 1.1(c); 1.2(a); 1.3; 1.4(a); 1.15(a); 3.2; 8.1(b); and 8.4(a)-(c).
The hearing panel issued an order of reprimand with conditions relative to the established misconduct. Costs were assessed in the amount of $630.68.
On July 30, 2001, the Grievance Administrator filed a petition for review with the Attorney Discipline Board and a show cause hearing was scheduled for October 18, 2001. The Grievance Administrator subsequently filed a motion to dismiss the appeal and the Attorney Discipline Board entered an order on August 30, 2001 dismissing the petition for review and vacating the order to show cause.
