NOTICE OF SUSPENSION (By Consent)

Case No. 01-6-GA Notice Issued: July 23, 2001 Richard C. Holst, P-26110, Wyoming, Michigan, by Attorney Discipline Board Kent County Hearing Panel #6.

1. Suspension - 30 Days; 2. Effective July 21, 2001. The respondent and the Grievance Administrator filed a stipulation for a consent order of discipline in accordance with MCR 9.115(F)(5). The stipulation was approved by the Attorney Grievance Commission and accepted by the hearing panel. The respondent offered a plea of no contest to the charges of misconduct in Counts One, Two, Three, Four and Six of Formal Complaint 01-6-GA, to wit: In two matters, respondent failed to promptly handle the matters for which he was retained, failed to maintain reasonable communication with his clients; and made false statements to his clients concerning the status of their matters. Further, respondent failed to file answers to two requests for investigation served upon him by the Grievance Administrator. Respondent's conduct was in violation of MCR 9.104(1)-(4) and (7); MCR 9.113(A); MCR 9.113(B)(2); and Michigan Rules of Professional Conduct 1.1(c); 1.2(a); 1.3; 1.4; 8.1(b); and 8.4(a)-(c). The parties also agreed that Count Five of Formal Complaint 01-6-GA may be dismissed and that respondent should be suspended for 30 days. The parties further agreed that respondent shall pay restitution. The hearing panel ordered that respondent's license to practice law be suspended for 30 days and that he pay restitution in the aggregate amount of $950.00. Costs were assessed in the amount of $229.63.
