NOTICE OF SUSPENSION (By Consent)

The respondent and the Grievance Administrator filed a stipulation for a consent order of discipline in accordance with MCR 9.115(f)(5) which was approved by the Attorney Grievance Commission and accepted by the hearing panel. Respondent pled no contest to the allegations of professional misconduct contained in Formal Complaint 00-187-GA, specifically that in an estate planning matter, respondent sold Detroit Edison stock without his client's permission and took possession of the sale proceeds; failed to properly safeguard the funds and to maintain the funds in a client trust account; and misappropriated the funds. Further, respondent failed to file an answer to a request for investigation served by the Grievance Administrator. Respondent=s conduct was in violation of MCR 9.104(1)-(4) and (7); MCR 9.113(A); MCR 9.113(B)(2); and Michigan Rules of Professional Conduct 1.15(a)-(c); 8.1(b); and 8.4(a)-(c). The parties agreed that an order of suspension should be entered retroactive to May 9, 2001.

The hearing panel ordered that respondent=s license be suspended for five years and costs were assessed in the amount of $16.04.
