The hearing panel found by default that respondent had failed to notify his client of his receipt of $12,500.00 in settlement funds; failed to promptly pay his client her share of the settlement funds; failed to maintain the funds in a client trust account; and misappropriated the funds. Respondent also failed file an answer to a request for investigation served by the Grievance Administrator. Respondent=s conduct was in violation of MCR 9.104(A)(1)-(4); MCR 9.113(A): and Michigan Rules of Professional Conduct 1.15(a) and (b); and 8.4(a)-(c).
The hearing panel ordered that respondent=s license be suspended for five years and that this suspension shall run concurrent with the five year suspension ordered in Grievance Administrator v Scott M. McDonald, ADB Case Nos. 00-95-GA; 00-131-GA; 01-15-GA. The panel further ordered that respondent pay restitution in the amount of $12,500.00, plus statutory interest, along with costs in the amount of $134.51.
