NOTICE OF REPRIMAND AND PROBATION (By Consent)
Case No. 00-71-GA Notice Issued: April 18, 2001 Robert C. Anderson, P-30102, Marquette, Michigan, by the Attorney Discipline Board Upper Peninsula Hearing Panel #3.
1. Reprimand; 2. Probation - 6 Months; 3. Effective April 18. 2001. The respondent and the Grievance Administrator filed a stipulation for a consent order of discipline in accordance with MCR 9.115(f)(5) which was approved by the Attorney Grievance Commission and accepted by the hearing panel. Respondent offered a plea of no contest to Counts One and Two of Formal Complaint 00-71-GA, specifically: That respondent failed to disclose a conflict of interest; and backdated a trust document and his signature and notary on that document by six years. Respondent=s conduct was in violation of MCR 9.104(1)-(4); and Michigan Rules of Professional Conduct 1.2(a); 1.7(b); 1.9(a); 1.16(a)(1); 4.1; and 8.4(a)-(c).
Based upon the stipulation of the parties, the hearing panel ordered that respondent be reprimanded with a six month probation and pay restitution to the complainant in the amount of $3,000.00. Costs were assessed in the amount of $2,335.56.
