1. Dismissal; 2. Effective March 29, 2001. On April 4, 2000, the Grievance Administrator filed Formal Complaint 00-52-GA alleging that respondent had committed acts of professional misconduct, specifically: That in a bankruptcy matter, respondent failed to ensure that his client's petition was not filed after she instructed him to take no action on her behalf; failed to advise his client that she would be responsible for the balance in filing fees; failed to take any action to protect his client from being held responsible for the balance owing on the filing fees; failed to appear at the show cause hearing; and failed to advise the court or his client that he would not appear at the show cause hearing. Respondent=s conduct was alleged to have been in violation of MCR 9.104(1)-(4); and Michigan Rules of Professional Conduct 1.1(c); 1.3; 1.4(b); 3.4(c); 3.5(c); and 8.4(a) and (c).
On March 7, 2001, the hearing panel entered an order dismissing Formal Complaint 00-52-GA. The Grievance Administrator filed a filed a petition for review but subsequently withdrew it. On June 15, 2001, the Attorney Discipline Board issued an order dismissing the petition for review. No costs were assessed against respondent.
