FINAL NOTICE OF REVOCATION Case No. 99-145-GA Notice Issued: November 13, 2001 Edgar J. Dietrich, P-12767, Grosse Pointe, Michigan by the Attorney Discipline Board increasing Tri-County Hearing Panel #19's order of discipline from a three year suspension to a revocation of respondent's license.

1. Revocation; 2. Effective March 28, 2001. The hearing panel found that the respondent had committed misconduct, specifically: That respondent, having direct supervisory authority over a suspended lawyer, allowed the suspended lawyer to act as respondent=s attorney at a deposition and court hearing and allowed the suspended attorney to appear in court as attorney for a client in a criminal matter on three occasions. Respondent also knowingly made false statements in his answer to a request for investigation. Respondent=s conduct was found to be in violation of MCR 9.104(1)-(4), (6) and (7); MCR 9.113(A); and Michigan Rules of Professional Conduct 5.1(b) and (c); 8.1(a); and 8.4(a)-(c).

The panel ordered that respondent=s license be suspended for three years with conditions relative to the established misconduct.

The Grievance Administrator and the respondent filed petitions for review. On September 19, 2001, the Attorney Discipline Board issued an Opinion and Order affirming the hearing panel's findings and conclusions but increasing the sanction from a three year suspension to a revocation of respondent's license to practice law in Michigan. The respondent filed a motion for reconsideration which was denied by the Attorney Discipline Board on October 18, 2001. Costs were assessed in the amount of $1,959.74.
