NOTICE OF SUSPENSION Case No. 00-8-GA Notice Issued: February 5, 2001 Michael J. Kieltyka, P-28766, Troy, Michigan, by the Attorney Discipline Board Tri-County Hearing Panel #33.
1. Suspension - 3 Years; 2. Effective February 5, 2001. The hearing panel found, by default, that respondent had committed the professional misconduct alleged in Formal Complaints 00-08-GA and 00-23-FA, specifically: That in numerous civil litigations, respondent failed to initiate legal action on behalf of his clients; made false statements to his clients regarding the status of their matters; failed to respond to inquiries from his clients regarding the status of their matters; and failed to inform his clients that their cases had been dismissed. Respondent also failed to file documents on behalf of a client; and failed to notify his client of a settlement offer and settled the case without authority from his client. Further, respondent failed to file an answer to the formal complaint served upon him by the Grievance Administrator. Respondent=s conduct was in violation of MCR 9.104(1)-(4) and (7); and Michigan Rules of Professional Conduct 1.1(c); 1.2(a); 1.3; 1.4; 1.16(d); 3.2; 8.1(b); 8.4(a)-(c).
The hearing panel ordered that respondent=s license be suspended for three years. Costs were assessed in the amount of $312.49.
