NOTICE OF REPRIMAND AND PROBATION (By Consent)

Case No. 00-135-GA Notice Issued: March 9, 2001 Mark H. Teklinski, P-21319, Warren, Michigan, by the Attorney Discipline Board Tri-County Hearing Panel #102.

1. Reprimand and Probation - 1 Year; 2. Effective March 9, 2001. The respondent and the Grievance Administrator filed a stipulation for a consent order of discipline in accordance with MCR 9.115(f)(5) which was approved by the Attorney Grievance Commission and accepted by the hearing panel. Respondent offered a plea of no contest to the charges of misconduct contained in Counts Two and Five of Formal Complaint 00-135-GA, specifically: In one immigration matter, respondent failed to timely file an affidavit of support or an application for adjustment of status before a scheduled hearing date causing his client=s petition to be dismissed and an order of deportation to be issued. In a second immigration matter, respondent failed to advise his client that withdrawing his petition for asylum would significantly and adversely affect his grounds for appeal. In two matters, respondent failed to respond to his clients= attempts at communication prior to their scheduled hearing dates. Respondent=s conduct was in violation of MCR 9.104(1)-(4); and Michigan Rules of Professional Conduct 1.1(a)-(c); 1.3; 1.4; 3.2; 3.4(c); and 8.4(a) and (c). The parties further agreed that Counts One, Three and Four of Formal Complaint 00-135-GA be dismissed.

Based upon the stipulation of the parties, the hearing panel ordered that respondent be reprimanded and placed on probation for one year. Costs were assessed in the amount of $283.52.
