NOTICE OF SUSPENSION (By Consent)

Case No. 01-44-AI Notice Issued: September 5, 2001 Scott F. Bergo, P-25455, Bingham Farms, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #64.

1. Suspension - 179 Days; 2. Effective March 5, 2001. On March 5, 2001, respondent was convicted in Livingston County Circuit Court of Operating a Motor Vehicle While Under the Influence of Alcohol - 3rd Offense and Driving a Motor Vehicle While License Suspended, Revoked or Denied - 2nd Offense, in violation of MCL 257.6251-A and MCL 257.6256D, respectively. In accordance with MCR 9.120(B)(1), respondent=s license to practice law in Michigan was automatically suspended on the date of his felony conviction.

The respondent and the Grievance Administrator filed a stipulation for a consent order of discipline in accordance with MCR 9.115(F)(5). The stipulation was approved by the Attorney Grievance Commission and accepted by the hearing panel. The respondent offered a plea of no contest to the charges of misconduct in Formal Complaints 01-44-AI and 01-60-JC. The parties agreed that respondent should be suspended for 179 days with conditions relevant to the established misconduct.

The hearing panel ordered that respondent's license to practice law be suspended for 179 days and assessed costs in the amount of $15.80.
