NOTICE OF REPRIMAND (By Consent)
Case No. 99-67-GA Notice Issued: January 11, 2001 Scott D. Sitner, P-46068, Bingham Farms, Michigan, by the Attorney Discipline Board Tri-County Hearing Panel #70.
1. Reprimand; 2. Effective January 10, 2001. The respondent and the Grievance Administrator filed a stipulation for a consent order of discipline in accordance with MCR 9.115(f)(5) which was approved by the Attorney Grievance Commission and accepted by the hearing panel. The parties agreed to accept the findings of misconduct contained in the Report of Tri-County Hearing Panel #70, dated June 6, 2000, specifically: That in a litigation matter, respondent failed to advise his client that a motion for summary disposition had been filed; failed to file a response to the motion for summary disposition or otherwise take steps to protect his client=s interests in response to the motion; and failed to inform his client in a timely fashion that the action had been dismissed with prejudice. Respondent=s conduct was found to be in violation of MCR 9.104(1) and (4); and Michigan Rules of Professional Conduct 1.1(c); 1.3; 1.4(a) and (b); and 8.4(c).
Based upon the stipulation of the parties, the hearing panel ordered that respondent be reprimanded. Costs were assessed in the amount of $924.22.
