NOTICE OF REVOCATION AND RESTITUTION Case No. 02-109-GA Notice Issued: January 21, 2003 Philip L. Dulmage, P-13009, Flint, Michigan, by the Attorney Discipline Board Genesee County Hearing Panel #1.

1. Revocation; 2. Effective February 19, 2001. 1 The hearing panel found, by default, that respondent failed to respond to a motion for summary disposition and failed to appear for a hearing on behalf of one client. With regard to a second client; respondent failed to communicate with this client; failed to appear for two hearings; failed to return unearned fees; and failed to advise this client that his license to practice law in Michigan had been suspended. Respondent also failed to file answers to two requests for investigation served by the Grievance Administrator.

Respondent=s conduct was in violation of MCR 9.104(A)(1)-(4) and (7); MCR 9.113(A); MCR 9.113(B)(7); MCR 9.119(A)(1)-(6); and Michigan Rules of Professional Conduct 1.1(c); 1.3; 1.4(a) and (b); 1.16(d); 8.1(a)(2); and 8.4(a) and (c). The panel issued an order revoking respondent's license to practice in Michigan, to run concurrently with the 180 day suspension ordered in Grievance Administrator v Philip L. Dulmage, Case No. 00-138-GA; 00-152-FA; and the three year suspension ordered in Grievance Administrator v Philip L. Dulmage, Case No. 02-44-GA. The panel also ordered that respondent pay restitution in the amount of $750.00 and assessed costs in the amount of $1,863.03.
