Dismissal.

The Grievance Administrator filed Formal Complaint 99-46-GA on April 16, 1999 charging that respondent had committed acts of professional misconduct, specifically: Respondent was alleged to have filed a federal lawsuit, appeal and petition for a writ of certiorari which were not supported by fact or law and which were frivolous; contacted a party to the action who was represented by counsel without obtaining the consent of counsel; asserted or controverted an issue in a proceeding without a meritorious basis; and used means that had no substantial purpose other than to embarrass, delay or burden a third person. Respondent=s conduct was alleged to have been in violation of MCR 9.104(1)-(4); and Michigan Rules of Professional Conduct 3.1; 4.2; 4.4; 8.4(a)-(c)

On December 27, 2000, the hearing panel entered an order dismissing Formal Complaint 99-46-GA. On January 17, 2001, the Grievance Administrator filed a petition for review and a show cause hearing was scheduled for April 19, 2001. On January 29, 2001, the Grievance Administrator filed a motion to vacate the order to show cause and withdrew its petition for review. The Attorney Discipline Board entered an order on January 30, 2001 granting the motion to vacate order to show cause. No costs were assessed against respondent.
