1) Suspension - 1 Year; 2) Effective December 27, 2000. The hearing panel found that the allegations in the formal complaint were established by default, to wit: That respondent failed to comply with the requirements of his Judgment of Divorce; obtained attorney funds in violation of an Asset/Attorney Fee Restraining Order; filed a Chapter 11 bankruptcy petition on September 29, 1995 in violation of a September 28, 1995 order barring respondent from filing a Chapter 11 bankruptcy petition for six months; failed to respond to a request for investigation served by the Grievance Administrator; and failed to file answers to the formal complaints.
Respondent=s conduct was found to be in violation of MCR 9.103(C); MCR 9.104(1)-(4), (7); MCR 9.113(A); MCR 9.113(B)(2); and Michigan Rules of Professional Conduct 3.4(c); 3.5(c); 8.1(b) and 8.4(a)-(c).
The panel ordered that respondent=s license be suspended for 1 year. Costs were assessed in the amount of $213.64.
