NOTICE OF SUSPENSION (Pending Appeal)

Case No. 00-116-GA Issued: November 27, 2000 Neal Bush, P-11471, Detroit, Michigan by the Attorney Discipline Board Tri-County Hearing Panel #16.

Suspension - 18 Months. 1 Effective November 23, 2000.

The hearing panel found that the allegations of professional misconduct in the formal complaint were established by respondent=s admission, specifically: That when retained to file a petition for writ of certiorari in the United States Supreme Court, respondent failed file that petition; failed to advise his client that he had not filed the petition or that he would not do so; failed to keep his client informed regarding the status of his appeal bond; and failed to answer a request for investigation served by the Grievance Administrator.

Respondent=s conduct was found to be in violation of MCR 9.103(C); MCR 9.104(1)-(4) and (7); MCR 9.113(A); MCR 9.113(B)(2); and Michigan Rules of Professional Conduct 1.1(a)-(c); 1.2(a); 1.3; 1.4(a) and (b); 8.1(b); and 8.4(a) and (c). The panel ordered that respondent=s license be suspended for 18 months. Costs were assessed in the amount of $400.47.

On November 15, 2000, the complainant filed a petition for review regarding restitution and the return of his file. The complainant=s petition is currently pending before the Attorney Discipline Board. The respondent did not request a stay of discipline and the suspension became effective on November 23, 2000.
