NOTICE OF REVOCATION Case Nos. 99-102-GA; 99-130-FA Notice Issued: August 15, 2001 Frederick A. Petz, P-28327, Grosse Pointe Woods, Michigan by the Attorney Discipline Board, increasing Tri-County Hearing Panel #15's order of suspension from 30 months to revocation.

Revocation. Effective November 1, 2000.

The hearing panel found that the allegations in the formal complaints were established by a preponderance of the evidence, specifically: That respondent misappropriated client funds; converted the funds to his personal use; and made misleading statements to his client about the availability of her money and when it would be paid to her.

Respondent=s conduct was found to be in violation of MCR 9.104(1)-(4) and Michigan Rules of Professional Conduct 1.4; 1.8; 4.1; and 8.4(a)- (c). The panel ordered that respondent=s license be suspended for 30 months effective September 1, 2000. Costs were assessed in the amount of $1,012.15.

Both the Grievance Administrator and respondent filed petitions for review. The respondent also requested a stay of discipline. On August 31, 2000, the Attorney Discipline Board issued an order granting respondent a temporary stay of discipline until November 1, 2000.

A review hearing was held and on July 23, 2001, the Attorney Discipline Board issued an order and opinion increasing respondent's discipline from a 30 month suspension to revocation of respondent's license to practice law in Michigan, effective November 1, 2000. Additional costs were assessed in the amount of $105.25.
