2.

Dismissal.

Effective November 14, 2000.

The Grievance Administrator filed Formal Complaint 00-106-GA on June 12, 2000 charging that respondent had committed acts of professional misconduct, specifically: That respondent, in a personal injury matter, arranged for his client to receive settlement monies directly from the insurance company instead of in a single check made payable to respondent and his client. The complaint further alleged that respondent had disobeyed a court order to withhold the settlement monies for his client=s child support arrearage. Respondent=s conduct was alleged to have been in violation of MCR 9.104(1)-(4); and Michigan Rules of Professional Conduct 3.4(c); and 8.4(a) and (c).

The hearing panel conducted a hearing on September 14, 2000 and filed a report concluding that professional misconduct had not been established. On October 23, 2000, the panel entered an order dismissing Formal Complaint 00-106-GA. No costs were assessed against respondent.
