NOTICE OF REPRIMAND (By Consent)

Case No. 00-36-GA Issued: October 9, 2000 Brian D. Albritton, P-46197, Bloomfield Hills, Michigan, by the Attorney Discipline Board Tri-County Hearing Panel #71.

1. Reprimand; 2. Effective October 7, 2000. The respondent and the Grievance Administrator filed a stipulation for a consent order of discipline in accordance with MCR 9.115(f)(5) which was approved by the Attorney Grievance Commission and accepted by the hearing panel. Respondent offered a plea of no contest to the charges of misconduct contained in Count One, paragraphs 6(a) and 6(e), and Counts Two and Five of Formal Complaint 00-36-GA, to wit: Respondent failed to render any services on behalf of his client; failed to collect the underlying judgment on behalf of his client; failed to communicate with his client; failed to execute a written contingent fee agreement for the collection action; and entered into a loan arrangement with his client without obtaining his client=s consent to the loan in writing or disclosing the terms in writing and without providing his client the opportunity to seek the advice of independent counsel regarding the loan. Respondent=s conduct was found to be in violation of MCR 9.104(1)-(4); and Michigan Rules of Professional Conduct 1.1(c); 1.2(a); 1.3; 1.4(a); 1.5(c); 1.8(a); 3.2; and 8.4(a) and (c). The parties agreed that respondent should be reprimanded. Costs were assessed in the amount of $238.03.
