DISMISSAL Case No. 98-107-GA Eugene F. Hanlon, P-14605, Ann Arbor, Michigan, by the Attorney Discipline Board affirming an order of dismissal by the Washtenaw County Hearing Panel #6.

1. Dismissal. 2. Effective October 6, 2000. The Grievance Administrator filed Formal Complaint 98-107-GA on June 6, 1998, charging that respondent had committed acts of professional misconduct, specifically: That respondent made misrepresentations to his clients; tried to collect a fee at his hourly rate for work performed by another attorney; charged his clients interest in excess of the statutory limit; and revealed a client=s secret to the disadvantage of the client. Respondent was alleged to be in violation of MCL 438.31; MCR 9.104(1)-(4); and Michigan Rules of Professional Conduct 1.5; 1.6(b); 4.1; and 8.4(a)-(c).

The hearing panel conducted a hearings on October 2, 1998 and May 12, 1999 and filed a report concluding that professional misconduct had not been established. On May 17, 2000, the panel entered an order dismissing Formal Complaint 98-107-GA. On June 7, 2000, the Grievance Administrator filed a petition for review. The Attorney Discipline Board held a review hearing on August 17, 2000 and on September 15, 2000, issued an order affirming the hearing panel=s dismissal. No costs were assessed against respondent.
