DISMISSAL Case No. 99-164-GA Abraham Weberman, P-22079, Detroit, Michigan, by the Attorney Discipline Board Tri-County Hearing Panel #8.

1. Dismissal. 2. Effective November 1, 2000. The Grievance Administrator filed Formal Complaint 99-164-GA on October 13, 1999 charging that respondent had committed acts of professional misconduct, specifically: That respondent received two checks from General Motors on behalf of his client and, knowing that the second check was issued in error, did not notify General Motors; failed to return the second check to General Motors until legal action was filed by General Motors; and failed to promptly notify his client of the receipt of the second check. Respondent=s conduct was alleged to have been in violation of MCR 9.104(1)-(4); and Michigan Rules of Professional Conduct 1.15(b) 8.4(a)-(c).

The hearing panel conducted hearings on December 6, 1999 and March 30, 2000 and filed a report concluding that professional misconduct had not been established. On October 10, 2000, the panel entered an order dismissing Formal Complaint 99-164-GA. No costs were assessed against respondent.
