FINAL NOTICE OF SUSPENSION Case No: 98-114-GA Issued: July 3, 2000 Harvey J. Zameck, P-22687, Southfield, MI, by the Attorney Discipline Board affirming the order of Tri-County Hearing Panel #70.

1)Suspension - 90 days; 2)Effective July 17, 2000. Respondent failed to answer the formal complaint but appeared before the hearing panel and admitted the allegations in the complaint that he was retained to represent a client in a medical malpractice claim but neglected the matter and failed to take appropriate action to protect his client=s rights prior to the expiration of the statute of limitations; that he failed to promptly comply with his client=s requests for information about the status of her case; that he failed to provide a full and fair response to a request for investigation; and that he failed to comply with a lawful subpoena issued by the Attorney Grievance Commission, all in violation of MCR 9.103(C); MCR 9.104(1)-(4) and (7); MCR 9.113(B)(2) and Michigan Rules of Professional Conduct 1.1(c); 1.3; 1.4(a) and (b); 8.1(b) and 8.4(a)-(c).

The respondent petitioned for review of the hearing panel=s order suspending his license for 90 days.

In an opinion affirming the hearing panel=s decision, the Board noted that the 90 day suspension was in accord with the applicable American Bar Association Standards for Imposing Lawyer Sanctions and prior opinions of the Board. The respondent=s application for leave to appeal was denied by the Michigan Supreme Court in an order entered June 26, 2000. The Court ordered that the stay of discipline granted pursuant to MCR 9.115(K) and MCR 9.122(C) would remain in effect until 21 days after the Court=s order. Costs were assessed in the amount of $1,246.18.
