NOTICE OF SUSPENSION AND RESTITUTION (With Conditions)

Case No. 00-48-GA Issued: September 25, 2000 Neal Bush, P-11471, Detroit, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #12.

Suspension - 18 Months Effective September 22, 2000.

Based upon the stipulation of the parties, the panel found that the charges of misconduct in Formal Complaint 00-48-GA were established, specifically: In one matter, respondent failed to submit a transfer request to the Michigan Department of Corrections. In a parole matter, respondent failed to arrange for a handwriting analysis of the subject letter. Respondent also failed to return unearned fees; failed to keep his clients reasonably informed regarding the status of their matters or respond to their numerous telephone messages; and failed to answer three requests for investigation. Respondent=s conduct was found to be in violation of MCR 9.103(C); MCR 9.104(1)-(4) and (7); MCR 9.113(A); MCR 9.113(B)(2); and the Michigan Rules of Professional Conduct 1.1(a)-(c); 1.2(a); 1.3; 1.4(a) and (b); 1.5(a); 1.16(d); 8.1(b); and 8.4(a) and (c).

The hearing panel ordered that respondent=s license to practice law in the Michigan be suspended for 18 months with conditions relevant to the established misconduct. The panel also ordered respondent to pay restitution in the aggregate amount of $2,200.00 to the complainants. Costs were assessed in the amount of $329.91.
