DISMISSAL Case No. 99-140-GA Christiana Nance, P-46896, Detroit, Michigan, by the Attorney Discipline Board Tri-County Hearing Panel #29.

1. Dismissal. 2. Effective October 10, 2000. The Grievance Administrator filed Formal Complaint 99-140--GA on September 7, 1999, charging that respondent had committed acts of professional misconduct, specifically: When Respondent was retained to investigate the caretaker of her client=s deceased grandmother, respondent failed to investigate the allegations, failed to contact witnesses; failed to obtain the bank records; relied on representations made by the caretaker; failed to inform her client of the status of the investigation; failed to earn the $400.00 fee; and knowingly made misrepresentations in her sworn statement to the Attorney Grievance Commission. Respondent was alleged to be in violation of MCR 9.103(C); MCR 9.104(1)-(4) and (6); MCR 9.113; and Michigan Rules of Professional Conduct 1.1(b) and (c); 1.2; 1.3; 1.4; 1.5(a); 1.15(b); 1.16(d); 8.1(a); and 8.4(a)-(c). (Formal Complaint 99-159-FA was dismissed in conjunction with the granting of respondent=s motion to set aside default during the panel hearing on November 15, 1999.)

The hearing panel conducted hearings on November 15, 1999 and January 17, 2000 and filed a report concluding that professional misconduct had not been established. On September 18, 2000, the panel entered an order dismissing Formal Complaint 99-140-GA. No costs were assessed against respondent.
