NOTICE OF REPRIMAND AND RESTITUTION (By Consent)
Case No. 00-54-GA Issued: August 7, 2000 Kenneth J. Passage, P-32944, Royal Oak, Michigan, by the Attorney Discipline Board Tri-County Hearing Panel #73.
1. Reprimand; 2. Effective August 5, 2000. The respondent and the Grievance Administrator filed a stipulation for a consent order of discipline in accordance with MCR 9.115(f)(5) which was approved by the Attorney Grievance Commission and accepted by the hearing panel. Respondent offered a plea of no contest to the charges of misconduct contained in paragraphs 21(b) and (c) of Formal Complaint 00-54-GA, to wit: Respondent failed to take reasonable measures to ensure that his client was notified of two court hearings. Respondent=s conduct was in violation of Michigan Rules of Professional Conduct 1.4(b). The parties agreed that respondent should be reprimanded. The parties further stipulated that the respondent should pay restitution to the complainant in the amount of $675.00. Costs were assessed in the amount of $64.25.
