DISMISSAL Case No. 00-49-GA David H. Fried, P-13709, Detroit, Michigan, by Tri-County Hearing Panel #1. 1. Dismissal. 2. Effective July 14, 2000. The Grievance Administrator filed Formal Complaint 00-49-GA on March 30, 2000, charging that respondent had committed acts of professional misconduct, specifically: In an estate matter, respondent allegedly failed to investigate a potential medical malpractice claim; failed to institute litigation regarding the medical malpractice claim prior to the expiration of the statute of limitations; failed to advise his client of the statute of limitations and that he would not be instituting litigation; falsely represented that he was still investigating the medical malpractice matter after the statute of limitations had expired; abandoned the representation of the medical malpractice matter and the estate without notice to his client; and failed to communicate with his client. Respondent was alleged to be in violation of MCR 9.104(1)-(4); and Michigan Rules of Professional Conduct 1.1(c); 1.2(a); 1.3; 1.4; 3.2; and 8.4(a)-(c).

The hearing panel conducted a hearing on May 25, 2000 and filed a report concluding that professional misconduct had not been established. The panel entered an order dismissing Formal Complaint 00-49-GA. No costs were assessed against respondent.
