The hearing panel found by default that respondent had committed professional misconduct, specifically: That respondent failed to communicate with his clients; failed to return unearned fees; neglected his clients= matters; failed to notify his active clients of his suspension to practice law in a prior disciplinary proceedings; failed to respond to three requests for investigation served by the Attorney Grievance Commission; failed to honor an investigative subpoena served by the Attorney Grievance Commission; and failed to answer Formal Complaint 00-009-GA. The hearing panel concluded that respondent=s conduct violated MCR 9.103(C); MCR 9.104(1)-(4) and (7); MCR 9.112(D)(2); MCR 9.113(A); MCR 9.113(B)(2); MCR 9.119(A)(1)-(6); and Michigan Rules of Professional Conduct 1.1(c); 1.2(a); 1.3; 1.4(a) and (b); 1.5(a); 1.15(b); 1.16(d); 3.2; 8.1(b); and 8.4(a) and (c).

The panel ordered that respondent=s license to practice law in the State of Michigan be suspended for three years. The panel further ordered that respondent pay restitution in the aggregate amount of $1,650.00. Costs were assessed in the amount of $305.26.

1 Respondent was suspended from the practice of law for 180 days on March 30, 1999. That suspension remains in effect. See Notice of Suspension dated March 30, 1999. Respondent was also suspended from the practice of law for failure to pay his annual dues to the State Bar of Michigan, effective February 9, 1999.
