NOTICE OF REPRIMAND Case No. 99-12-GA Notice Issued: March 14, 2002 Richard L. Austin, P-24201, Flint, Michigan, by the Attorney Discipline Board Genesee County Hearing Panel #4, after remand by the Attorney Discipline Board.
1. Reprimand. 2. Effective May 19, 2000. The hearing panel found that respondent, while representing Flint Township in a drunk driving prosecution against a female defendant, engaged in professional misconduct by pursuing a consensual sexual relationship with the defendant. Respondent's conduct was in violation of MCR 9.104(2) and (3). The hearing panel ordered that respondent be reprimanded.
The Grievance Administrator petitioned for review and the Board, upon review, remanded the matter to the panel but did not retain jurisdiction. The hearing panel filed its opinion on remand affirming its order of reprimand. Costs were assessed in the amount of $2,161.26.
