NOTICE OF REPRIMAND (By Consent)

Case No. 00-15-GA Issued: July 13, 2000 Richard C. Holst, P-26110, Wyoming, Michigan, by the Attorney Discipline Board Kent County Hearing Panel #5.

1.Reprimand; 2.Effective July 12, 2000. The respondent and the Grievance Administrator filed a stipulation for a consent order of discipline in accordance with MCR 9.115(f)(5) which was approved by the Attorney Grievance Commission and accepted by the hearing panel. Respondent offered a plea of no contest to the charges of misconduct contained in Counts One and Three of Formal Complaint 00-15-GA, to wit: In a driver=s license revocation matter, respondent failed to promptly contact the Secretary of State to schedule a hearing for his client; failed to file an appeal on behalf of his client; failed to respond to his client=s numerous inquiries as to the status of his matter; failed to maintain reasonable communication; and failed to return his client=s file upon termination of the representation. Respondent=s conduct was alleged to be in violation of MCR 9.104(1)-(4) and the Michigan Rules of Professional Conduct 1.1(c); 1.3; 1.4; 1.15(b); 1.16(d) and 8.4(a) and (c). The parties agreed that the allegations contained in Count Two of Formal Complaint 00-15-GA may be dismissed. The parties further stipulated that the respondent be reprimanded. Costs were assessed in the amount of $68.62.
