The respondent and the Grievance Administrator filed a stipulation for a consent order of discipline in accordance with MCR 9.115(F)(5). The stipulation was approved by the Attorney Grievance Commission and accepted by the hearing panel. The respondent offered a plea of no contest to the following charges: Between July 1991 and March 1997, while serving as the trustee or co-trustee under the authority of certain trust instruments which he had drafted, respondent withdrew funds belonging to the trusts and then deposited those funds into the account of a business entity which he owned or expended the funds for his personal use. Respondent=s conduct was found to be in violation of MCR 9.104(1)-(4) and Michigan Rules of Professional Conduct 1.15(a)-(c) and 8.4(a)-(c). The parties further stipulated that respondent=s license to practice law should be suspended for three years and that respondent should be liable for restitution in the amount of $151,994.10. Costs were assessed in the amount of $391.44.
