NOTICE OF SUSPENSION Case No. 00-03-GA Issued: May 5,2000 Andrew P. Kwyer, P-45038, Southfield, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #58.

1) Suspension - 1 Year; 2) Effective May 5,2000. The panel found, by default, that respondent committed professional misconduct, to wit: In a personal injury action, respondent failed to comply with discovery demands; failed to respond to a motion to dismiss or to appear at the hearing on the motion, which resulted in the dismissal of his client's action; and failed to advise his client of dates scheduled for her deposition by the defendant. In a domestic matter, respondent failed to prepare quitclaim deeds; and failed to respond to contacts from opposing counsel. In a divorce matter, respondent failed to appear at trial resulting in dismissal of his client's

action; failed to return telephone calls from the Friend of the Court representative and the opposing counsel; and communicated personally and/or through his client with the opposing party without prior authority from opposing counsel. In addition, respondent also failed to respond to numerous status inquiries from his clients; failed to return his clients' files at their request; and abandoned the representation of his clients. Respondent also failed to answer two requests for investigation submitted by the Attorney Grievance Commission. The hearing panel concluded that respondent's conduct violated MCR 9.1 03(C); MCR 9.104(1 )-(4) and (7); MCR 9.113(A); MCR 9.113(B)(2) and Michigan Rules

of Professional Conduct 1.1 (a)-(c); 1.2(a); 1.3; 1.4(a); 1.16(d); 3.2; 4.2; 8.1 (b); and 8.4(a) and (c).

The panel ordered that respondent's license to practice law in the State of Michigan be suspended for one year. Costs were assessed in the amount of $179.07.
