NOTICE OF SUSPENSION (By Consent)

Case No. 00-64-GA Issued: September 29, 2000 Michael A. Conway, P-12165, Bloomfield Hills, Michigan, by the Attorney Discipline Board, Tri-County Hearing Panel #57.

Suspension - 5 Years; Effective February 28, 2000.

The respondent and the Grievance Administrator filed a stipulation for a consent order of discipline in accordance with MCR 9.115(f)(5) which was approved by the Attorney Grievance Commission and accepted by the hearing panel. Respondent offered a plea of no contest to the charges of misconduct contained in Formal Complaint 00-64-GA, to wit: In a divorce matter, respondent was ordered to place proceeds from the sale of the marital home in a client escrow account and not to disburse any funds until further order of the court. After depositing the funds in a client escrow account, respondent misappropriated those funds and knowingly misrepresented to other counsel that funds were remaining in the client escrow account. Respondent's conduct was found to be in violation of MCR 9.104(1)-(4); and Michigan Rules of Professional Conduct 1.15(a)-(b); 4.1; and 8.4(a)-(c). The panel ordered that respondent=s license be suspended for five years, retroactive to February 28, 2000. Costs were assessed in the amount of $200.98.
