NOTICE OF REPRIMAND (By Consent)

Case No. 98-234-GA Issued: February 11, 2000 Ben M. Gonek, P-43716, Detroit, Michigan, by the Attorney Discipline Board, Tri-County Hearing Panel #10.

1. Reprimand. 2. Effective February 5,2000. The respondent and the Grievance Administrator submitted a stipulation for consent order of discipline in accordance with MCR 9.115(f)(5). The stipulation was approved by the Attorney Grievance Commission and was accepted by a hearing panel. Respondent entered a plea of no contest to the allegations of professional misconduct contained in Formal Complaint No. 98-234-GA, to wit: respondent failed to file a brief on appeal in two matters causing the appeals to be dismissed; failed to file a brief on appeal to support the original claim of appeal causing client's appeal to be involuntarily dismissed; and failed to ascertain the correct jurisdictional time limit to file the application for leave to appeal regarding the trial court's denial of the delayed motion for new trial, causing the client to have a delayed application for leave to appeal. Respondent's conduct was alleged to be in violation of MCR 9.104(1 )-(4) and the Michigan Rules of Professional Conduct 1.1 (a)and (c); 1.3; 3.2 and 8.4(a) and (c). The parties agreed that respondent should be reprimanded. Costs were assessed in the amount of $190.43.
