NOTICE OF SUSPENSION Case No. 99-054-GA Issued: March 3, 2000 Sanford M. Kesten, P-15923, Flint, Michigan, by Attorney Discipline Board Genesee County Hearing Panel #1.

1) Suspension - 180 Days; 2) Effective February 24, 2000. The hearing panel found that the allegations in the formal complaint were established by preponderance of the evidence, to wit: respondent failed to properly represent a client in a driver's license matter; failed to appear on client's behalf at two pre-trials, a final pre-trial and trial; failed to notify the court of the reason for his failures to appear; failed to pay a judgment in full by the time permitted resulting in the issuance of a bench warrant for criminal contempt of court; and failed to answer a request for investigation served by the Attorney Grievance Commission. Respondent's conduct was found to be in violation of MCR 9.103(C); MCR 9.104(1)-(4) and (7); MCR 9.113(A); MCR 9.113(B)(2); and Michigan Rules of Professional Conduct 1.1 (c); 1.2(a); 1.3; 3.2; 3.4(c); 3.5(c); 8.1 (b); and 8.4(a) and (c).

The panel concluded that respondent's misconduct warranted a suspension of 180 days. Costs were assessed in the amount of $951.92.
