NOTICE OF REPRIMAND (By Consent)
Case No. 99-085-GA Thomas D. Burkhart, P-25509, Saginaw, Michigan, by the Attorney Discipline Board, Saginaw County Hearing Panel #1.
1. Reprimand. 2. Effective November 30, 1999. The respondent and the Grievance Administrator submitted a stipulation for consent order of discipline in accordance with MCR 9.115(f)(5). The stipulation was approved by the Attorney Grievance Commission and was accepted by a hearing panel. Respondent entered a plea of nolo contendere to the allegations of professional misconduct contained in Count One of Formal Complaint No. 99-085-GA, to wit that he failed to file a complaint or take any action on complainant=s behalf regarding a rezoning matter. Respondent=s conduct was alleged to be in violation of MCR 9.104(1)-(4) and the Michigan Rules of Professional Conduct 1.1(c); 1.2(a); 1.3; 3.2 and 8.4(a) and (c). The parties agreed that the allegations contained in Count Two of Formal Complaint 99-085-GA may be dismissed with prejudice. The parties further agreed that respondent should be reprimanded. Costs were assessed in the amount of $70.84.
