NOTICE OF SUSPENSION WITH CONDITIONS Case No. 98-236-GA Arthur C. Kirkland, Jr., P-27551, Detroit, Michigan, by the Attorney Discipline Board increasing Tri-County Hearing Panel #22's Order of Reprimand with Conditions.

1) Suspension - 30 Days; 2) Effective June 30, 1999. Respondent admitted that he failed to answer a Request for Investigation, in violation of MCR 9.103(C); MCR 9.104(1)-(4) and (7); MCR 9.113(A) and (B)(2); and Michigan Rules of Professional Conduct 8.1(b) and 8.4(a) and (c). The panel ordered that respondent be reprimanded, subject to conditions including continuing legal education in legal ethics or professional responsibility.

The Grievance Administrator filed a petition for review. In an order and opinion issued June 8, 1999, the Attorney Discipline Board increased discipline to a 30-day suspension, with conditions including either continuing legal education as described above or the successful completion of the Multistate Professional Responsibility Examination. In its opinion, the Board held that: "Based upon our review of the whole record, the aggravating and mitigating circumstances presented and respondent's apparent continued indifference to the nature and consequences of these proceedings, we conclude that a suspension of respondent's license for 30 days is warranted."

Costs were assessed in the total amount of $303.56.
