NOTICE OF SUSPENSION AND RESTITUTION (By Consent)
Case Nos. 99-003-GA; 99-019-FA June A. Porter, P-30589, Detroit, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #3.
1) Suspension - 90 Days; 2) Effective July 21, 1999.1 Respondent was retained to represent the complainant regarding a neglect complaint filed against her in Wayne County Probate Court, Juvenile Division. The complainant paid respondent a total of $215 to represent her in the juvenile proceedings. Respondent pled no contest to allegations that she neglected the matter; failed to refund the unearned fee upon request; and failed to answer the Request for Investigation.
The panel concluded that respondent's conduct violated MCR 9.103(C); MCR 9.104(1)-(4) and (7); MCR 9.113(A) and (B)(2); and Michigan Rules of Professional Conduct 1.1(a); 1.2(a); 1.3; 1.5(a); 1.15(b); 1.16(d); 3.2; 8.1(b); and 8.4(a) and (c).
The parties stipulated that respondent be suspended from the practice of law in Michigan for a period of 90 days and make restitution to the complainant in the amount of $175. Costs were assessed in the amount of $327.85.
