NOTICE OF REPRIMAND WITH CONDITIONS (By Consent)
Case No. 99-055-GA Allen J. Lewis, P-27978, Gobles, Michigan, by Attorney Discipline Board Berrien County Hearing Panel.
1) Reprimand; 2) Effective July 20, 1999. Respondent was on the roster of the Michigan Appellate Assigned Counsel System ("MAACS") since its establishment in December 1985, and accepted assignments of post-conviction criminal matters. Respondent pled no contest to allegations that he neglected such matters by failing to file timely applications for leave to appeal in two matters; failing to preserve issues for appellate review in five matters; and filing briefs on appeal which were several months late, and which resulted in the loss of the right to request oral arguments in 25 matters. The panel concluded that respondent's conduct violated MCR 9.104(1)-(4); and Michigan Rules of Professional Conduct 1.1(a)-(c); 1.2(a); 1.3; 3.2; 3.4(c); and 8.4(a) and (c).
The parties stipulated that respondent be reprimanded, subject to the following conditions: Attendance at, and completion of, legal writing and law office management seminars. Costs were assessed in the amount of $79.02.
