NOTICE OF SUSPENSION (With Conditions)

Terry M. Williams, P-37545, Detroit, Michigan, by the Attorney Discipline Board, affirming an order of Tri-County Hearing Panel #19.

Suspension for 30 days.

Effective September 16, 1999.

Respondent requested and was paid a $750 retainer for the purpose of instituting a suit against her client=s fire insurance carrier prior to the running of the statute of limitations but she failed to timely institute the suit, resulting in her client=s claim being barred by the statute of limitations.

The hearing panel concluded that respondent=s conduct had violated MCR 9.104(1)-(4) and the Michigan Rules of Professional Conduct 1.1(c); 1.3; 1.4; 3.2; and 8.4(a) and (c). On March 30, 1999, the panel ordered that the respondent be suspended from the practice of law in Michigan for 30 days with conditions relevant to the established misconduct.

A petition for review was filed by the Grievance Administrator and a cross-petition for review was filed by respondent. Respondent also filed a request for stay of discipline. On August 25, 1999, the Board affirmed the hearing panel=s order of 30 days suspension with conditions relevant to the established misconduct.

Costs were assessed in the amount of $524.63.
