NOTICE OF REPRIMAND (By Consent)

Case No. 99-004-GA Issued: February 11,2000 Richard C. McQuillan, P-37803, Jackson, Michigan, by the Attorney Discipline Board, Ingham County Hearing Panel #6.

1. Reprimand. 2. Effective June 15, 1999. The respondent and the Grievance Administrator submitted a stipulation for consent order of discipline in accordance with MCR 9.115(f)(5). The stipulation was approved by the Attorney Grievance Commission and was accepted by a hearing panel. Respondent has admitted the allegations of professional misconduct contained in Count Three of Formal Complaint 99-004-GA, to wit: that in his capacity as the attorney for the conservator of the estate of a protected person, respondent participated in an ex parte communication with the probate judge assigned to that case. Respondent's conduct was alleged to be in violation of MCR 9.104(1)-(4) and Michigan Rules of Professional Conduct 3.5(b) and 8.4(a)-(c). The parties have further stipulated that the allegations of professional misconduct contained in Counts One and Two of Formal Complaint 99-004-GA may be dismissed with prejudice and that respondent should be reprimanded. The complainant's complaint for mandamus was denied by the Supreme Court on January 31,2000. Costs were assessed in the amount of $114.09.
